The proposed development site is located to the east of A367 Fosseway in Midsomer Norton, Somerset. The application was for the development of up to 180 dwellings with access provided from A367.

Our Role

Brookbanks supported the application with a Transport Assessment and Travel Plan.

The application, whilst receiving officer recommendation for approval, was refused planning permission with the reasons given to the loss of open countryside/ agricultural land and the sites proximity to access local facilities and employment suggesting that the site was not accessible to non-car modes.

The Outcome

Brookbanks supported the appeal process by agreeing a Statement of Common Ground with the Local Highway Authority and providing a Proof of Evidence which demonstrated that there was no proper basis for the highway reasons for refusal.

Planning approval was subsequently granted by the Planning Inspector.
